1. Acceptance of Terms

By accessing or using Dakota Realty AI, you agree to these Terms of Service. If you do not agree, do not use the application.

These Terms apply to the website, application, demo, prototype, AI assistant, RAG search tools, property listings, dashboards, account features, uploads, appointment tools, and related services.

2. Demo and Portfolio Disclaimer

Dakota Realty AI may be a portfolio, prototype, demonstration, or testing project. It is provided for demonstration purposes only.

Features, listings, agent profiles, user accounts, property information, AI responses, RAG search results, uploaded content, dashboards, appointments, and other data may be simulated, incomplete, inaccurate, experimental, or subject to change.

You should not use this application for real transactions, legal decisions, financial decisions, investment decisions, real estate decisions, or storing sensitive information unless the application clearly states that it is a live production service.

We may modify, suspend, reset, or discontinue the application at any time without notice.

3. No Professional Advice

Dakota Realty AI does not provide legal, financial, investment, tax, appraisal, mortgage, insurance, real estate brokerage, or other professional advice.

Any information displayed in the application, including property information, listing information, market information, agent content, appointment tools, RAG search results, and AI-generated responses, is provided for general informational and demonstration purposes only.

You should consult qualified professionals before making real estate, legal, financial, tax, investment, mortgage, insurance, or property decisions.

4. RAG and AI Features

Dakota Realty AI may include retrieval-augmented generation, also known as RAG, AI chat, listing search, document search, property Q&A, and recommendation features.

These tools may retrieve information from listings, uploaded documents, database records, stored content, embeddings, vector search results, and other available context before generating a response.

AI-generated output and RAG results may be inaccurate, incomplete, outdated, misleading, or based on limited retrieved context. You are responsible for reviewing, verifying, and deciding whether to use any AI-generated or RAG-assisted output.

Do not rely on AI or RAG output as a substitute for professional advice, human review, independent research, inspections, due diligence, or licensed real estate guidance.

Do not submit sensitive, confidential, regulated, financial, legal, or highly personal information into AI/RAG features unless you understand and accept the risks.

5. User Accounts and Login

Some features may require an account or OAuth login. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

• Do not share your account with unauthorized users.
• Do not attempt to access another user’s account.
• Do not bypass authentication or security controls.
• Do not abuse guest usage limits, rate limits, or AI/RAG usage controls.
• Do not use the application for unlawful, abusive, or harmful purposes.

We may suspend or remove accounts that violate these Terms or create security, legal, or operational risks.

6. User Content and Uploads

You may be able to submit, upload, or create content, including text, prompts, property preferences, listing details, files, images, profile information, documents, appointment requests, messages, or feedback.

You are responsible for any content you submit. You represent that you have the rights necessary to submit and use that content.

• Do not upload content that violates any law.
• Do not upload content that infringes intellectual property rights.
• Do not upload malware or harmful code.
• Do not upload financial records, legal documents, government IDs, or sensitive personal information that should not be used in a demo.
• Do not upload false, misleading, fraudulent, discriminatory, or abusive content.
• Do not upload content that violates the privacy or rights of others.

By submitting content, you grant us permission to use, store, process, display, retrieve, embed, index, and transmit that content as needed to operate, test, improve, and provide the application, including RAG and AI-powered features.

7. Acceptable Use

• Do not attack, disrupt, overload, or interfere with the application.
• Do not attempt to reverse engineer or bypass security features.
• Do not scrape, harvest, or misuse data.
• Do not upload malicious files or code.
• Do not abuse AI features, rate limits, authentication systems, or demo accounts.
• Do not use the application to generate misleading, discriminatory, illegal, or harmful real estate content.
• Do not use the application for illegal, harmful, deceptive, or unauthorized purposes.

8. Real Estate and Listing Information

If the application displays property listings, agent profiles, showing tools, market information, search results, or real estate-related content, that information may be simulated, incomplete, outdated, or for demonstration only.

The application does not guarantee the accuracy, availability, pricing, condition, ownership, financing terms, status, zoning, school information, neighborhood information, taxes, fees, or completeness of any listing or property-related information.

Nothing in the application creates a broker-client, agent-client, fiduciary, attorney-client, lender-borrower, or professional relationship unless separately agreed in writing with a properly licensed professional.

9. Appointments and Showing Requests

Dakota Realty AI may include appointment, showing, contact, or calendar features. These features may be simulated, incomplete, or for demonstration only.

A submitted appointment or showing request does not guarantee availability, confirmation, agent representation, access to a property, or a professional relationship.

10. Third-Party Services

The application may rely on third-party services for hosting, authentication, databases, cloud storage, AI responses, embeddings, vector search, analytics, email, maps, logging, or other functionality.

We are not responsible for third-party services, their availability, their content, or their handling of data except as described in our Privacy Policy. Your use of third-party services may also be subject to their own terms and privacy policies.

11. Privacy

Your use of the application is also governed by our Privacy Policy, which explains how information may be collected, used, stored, and shared.

By using the application, you agree to the Privacy Policy.

12. Intellectual Property

The application, including its design, code, branding, content, layout, features, RAG tools, AI workflows, dashboards, and functionality, is owned by Christian Roubideaux or its licensors, unless otherwise stated.

You may not copy, modify, distribute, sell, or exploit any part of the application without permission.

13. Availability and Changes

The application may be unavailable, interrupted, changed, suspended, or discontinued at any time.

We do not guarantee that the application will be secure, error-free, uninterrupted, or available at all times.

14. Disclaimer of Warranties

The application is provided “as is” and “as available” without warranties of any kind, whether express or implied.

We disclaim all warranties, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, security, and suitability for real estate decisions.

15. Limitation of Liability

To the maximum extent permitted by law, Christian Roubideaux will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, profits, revenue, business, goodwill, property opportunity, transaction opportunity, AI/RAG output reliance, or use arising from or related to the application.

Your use of the application is at your own risk.

16. Indemnification

You agree to defend, indemnify, and hold harmless Christian Roubideaux from claims, damages, liabilities, losses, costs, and expenses arising from your use of the application, your submitted content, your violation of these Terms, your reliance on AI/RAG output, or your violation of any law or third-party rights.

17. Termination

We may suspend or terminate your access to the application at any time if we believe you violated these Terms, created risk, or used the application in an unauthorized or harmful way.

18. Governing Law

These Terms are governed by the laws of the United States and the applicable laws of the state where the application owner resides, without regard to conflict-of-law principles.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Your continued use of the application after changes are posted means you accept the updated Terms.
